Client Placement Agreement

By submitting a brief and engaging ADVLST Talent's services, you agree to the following:
1. THE SERVICE
1.1
ADVLST Talent will source, vet, and deliver 2-3 pre-tested creative professional profiles within 48 hours of receiving a completed brief.
1.2
Every profile includes actual work output from a real test task, scores, and a Talent Fingerprint.
1.3
A free 1-week trial is included before any payment is required.
2. PLACEMENT FEE
2.1
Standard: Rs.20,000 flat per hire. International: $240 USD.
2.2
Premium: Rs.25,000 / $300 USD.
2.3
Elite: Rs.35,000 / $420 USD.
2.4
A refundable deposit of Rs.5,000 is required before trial begins. Adjusted in final fee upon hire. Full refund if no hire is made.
2.5
Payment due within 7 days of hire confirmation.
2.6
Payment via UPI, bank transfer, Razorpay, or Wise (international).
3. FREE TRIAL
3.1
Every placement includes a free 1-week trial before payment.
3.2
If you choose not to hire after trial — full deposit refund within 24 hours. No questions.
3.3
If match is wrong during trial — replacement profile in 4 hours. Zero extra charge.
4. REPLACEMENT GUARANTEE
4.1
Standard: 30-day replacement.
4.2
Premium: 60-day replacement.
4.3
Elite: 90-day replacement.
4.4
Guarantee void if talent exit is caused by client misconduct, non-payment, or scope change without agreement.
5. NON-CIRCUMVENTION
5.1
Any talent introduced by ADVLST Talent is subject to our placement fee for 12 months from date of introduction.
5.2
Hiring talent introduced by us directly or through a third party without paying the fee is a breach.
5.3
Breach results in double the applicable fee plus legal costs.
6. CLIENT OBLIGATIONS
6.1
Provide accurate brief via our intake form.
6.2
Give honest trial feedback within 7 days.
6.3
Treat talent professionally within agreed scope.
6.4
Pay talent directly as per agreed rates after placement.
7. CONFIDENTIALITY
7.1
Talent profiles shared by ADVLST Talent are confidential.
7.2
Profiles may not be shared with third parties without written permission.
8. LIMITATION OF LIABILITY
8.1
ADVLST Talent's liability is limited to the placement fee paid.
8.2
Not liable for losses beyond the replacement guarantee period.
FOR TALENT
Creative Professional Agreement
By submitting an application and joining the ADVLST Talent network, you agree to the following:
1. WHAT ADVLST TALENT DOES FOR YOU
1.1
We pitch your profile to vetted agencies and companies at no cost.
1.2
We handle initial client communication until placement confirmed.
1.3
You will never be charged any fee. Placement, registration, or otherwise. Ever.
2. YOUR RESPONSIBILITIES
2.1
Portfolio must be genuine, current, and accurate.
2.2
Complete test task within 48 hours.
2.3
Respond to client briefs within 24 hours.
2.4
Maintain professional communication with all clients at all times.
2.5
Honour all commitments — deadlines, quality, and scope of work.
3. EXCLUSIVITY AND NON-CIRCUMVENTION
3.1
For any client introduced by ADVLST Talent — all communication must go through us for first 30 days.
3.2
If client contacts you directly — inform ADVLST Talent within 24 hours.
3.3
Accepting direct work from a client introduced by us — within 6 months — is a breach.
3.4
Breach results in permanent removal from the network.
4. PAYMENT
4.1
After placement, payment is directly between you and the client.
4.2
ADVLST Talent does not interfere in your rate post-placement.
4.3
Your agreed rate must be shared with ADVLST Talent before trial.
5. TRIAL PERIOD
5.1
Every placement begins with a free 1-week trial for the client.
5.2
During trial, work must meet the quality of your test task.
5.3
If client confirms hire — you are expected to continue.
5.4
Abandoning mid-trial without valid reason = removed from network.
6. CONDUCT
6.1
Unprofessional conduct, ghosting, or dishonest representation of skills results in immediate network removal.
6.2
ADVLST Talent may remove anyone from the network at any time.
7. CONFIDENTIALITY
7.1
Client information shared through ADVLST Talent is confidential.
7.2
Do not share client details with any third party.
GENERAL TERMS
General Terms & Governing Law
1. GOVERNING LAW
1.1
These terms are governed by the laws of India.
1.2
Jurisdiction: New Delhi, India.
1.3
Submitting a form constitutes acceptance of all applicable terms.
2. CHANGES TO TERMS
2.1
ADVLST Talent reserves the right to update these terms at any time.
2.2
Continued use of our services after changes = acceptance.
2.3
